MedStudy’s 12 Days Sweepstakes (the “Sweepstakes”) starts on December 1, 2021 at 11:00 a.m. Mountain Time (“MT”) and ends on December 12, 2021 at 11:59 p.m. MT (“Sweepstakes Period”). The Sweepstakes Period will be divided into twelve (12) daily entry periods as further outlined below (each, a “Daily Entry Period”). The winners will be chosen randomly and announced on December 12, 2021 at 11:00 a.m. MT. 

ELIGIBILITY: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, excluding residents of Rhode Island, who are the age of majority in their state of residence and at least 18 years of age as of date of entry. Employees of MedStudy Corporation (“Sponsor”), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies and members of their immediate families (spouse and parents, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void in Rhode Island and where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram or Facebook, Inc (“Facebook, Meta”).

HOW TO ENTER: During the Sweepstakes Period you may enter the Sweepstakes each day by following the directions on the daily 11:00 a.m. MT Instagram gift post announcement. You can receive up to two (2) entries for each day’s prize if you fully participate on that day on both platforms: Facebook and Instagram (from 11:00 a.m. MT to 11:59 p.m. MT) during the Sweepstakes Period. For example, on December 3, 2021 between 11:00 a.m. MT and 11:59 p.m. MT leave a comment on the Instagram post with how you give back during the holiday season for (1) entry, and comment on the daily Facebook post as well with how you give back during the holiday season for (1) entry. Each entry will give you a chance to win one of the three thousand dollar gift cards. On multiple days during the giveaway, there are ways to have more than 2 entries, those are listed below in each day's entry rules. There is no cost to enter.

All electronic entries must be received by 11:59 p.m. MT on the applicable prize day (i.e. December 1, 2021 – December 12, 2021) to be eligible to win the prize at the end of the Sweepstakes. If you choose to enter using your mobile phone, standard wireless data rates may apply. See your wireless provider for pricing plan details. Entries generated by script, macro, or other automated means or practices, or by any means which subvert the entry process will be void. Limit of three (2, unless otherwise stated in the post) entries per person each day throughout the Sweepstakes Period. Entries will not be acknowledged or returned. Sponsor’s database clock will be the official timekeeper for this Sweepstakes.

WINNER SELECTION: On or about 11:00 a.m. MT on December 13, 2021, MedStudy will select three (3) potential winners in a random drawing from all eligible entries received. For example, on or about 11:00 a.m. MT on December 13, 2021, MedStudy will select three (3) potential winners from the entries received during the entire span of December 1, 2021 to December 13, 2021. (i.e. those that followed the direction on MedStudy’s Instagram and Facebook posts between 11:00 a.m. MT and 11:59 p.m. MT on the days to enter). Odds of winning depend on the number of eligible entries received for each day of the Sweepstakes. We will draw another winner in the event that one of the entrants is selected twice.

WINNER NOTIFICATION: On or about 11:00 a.m. MT on December 13, 2021, the potential winners will be announced on our Instagram and Facebook accounts. They will be tagged in the posts and messaged directly. The potential winners will be required to respond to MedStudy within a 3 day time period specified by us or the applicable prize will be forfeited and MedStudy will have no further obligation to such potential winner. Upon receiving the response, MedStudy will request additional information from each potential winner. A potential winner will be instructed to provide his/her/their full name, email address, and city and state of residence. The potential winners may be required to complete an Affidavit of Eligibility, W-9, Liability and Publicity Release (unless prohibited by law) and any other documents required by MedStudy, which must be returned to and received by MedStudy within seven (7) calendar days of issuance. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of MedStudy to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by a potential winner may result in disqualification and, at MedStudy’s sole discretion, the applicable prize may be awarded to an alternate winner randomly selected from among all remaining eligible entries received.

Thursday, December 2, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. For the entry on Facebook, you must add your favorite holiday gif to the comment section. For the entry on Instagram, you must answer "All I want for the holidays is…” in the comment section. 

Friday, December 3, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then answer the question, "How do you give back during the holiday season?" on the platform you are participating on. 

Saturday, December 4, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then, direct message us your pet study pics for #PetsThatMedStudy on either Instagram or Facebook for 5 entries. 

Sunday, December 5, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then, like the day's entry post. You will receive an extra entry for the day if you share to your Instagram or Facebook story and tag us. 

Monday, December 6, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then, answer the question from our new student Qbank+ for Step 1 - you'll still be entered even if you get the answer wrong (you can receive an extra entry on this day if you tag a medical student to answer and enter too!) 

Tuesday, December 7, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then, follow the prompt "Have you used MedStudy before? What's your favorite product and what do you like about it? - If not, tag someone!" No purchase necessary for the entry. If you have not purchased MedStudy or used our products in the past, you can tag someone in the comments.  

Wednesday, December 8, 2021: Follow our TikTok @MedStudyStrong on this day for 3 entries. The TikTok handles who followed on this day during the entry time period will be collected. If the winner is chosen and it is a TikTok handle, they will be reached out to on the platform TikTok.This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with TikTok. A link to our TikTok will be provided on this day. 

Thursday, December 9, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then, follow the prompt and add your favorite holiday emoji in the comments to be entered for your chance to win. 

Friday, December 10, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Then, leave us your honest review on Facebook for 5 entries. All names of reviewers who leave a review on December 10, 2021 during the entry time will be collected and entered 5 times for a chance to win the prize. The reviewer must add "I am leaving this review to be entered for a chance to win in a giveaway" to count as a valid entry. 

Saturday, December 11, 2021: Make sure you are following MedStudy on the platform you are participating on, Facebook or Instagram. Tag your favorite person or people to spend the holidays with on either Facebook or Instagram to be entered for one (1) entry.

Monday, December 13, 2021: 3 winners will be announced. 

All federal, state, and local taxes and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of each winner. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by sponsor. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Released Parties (as defined below) disclaim any and all liability for the actual provision, quality or nature of any prize (or portion thereof) accepted by the winner. MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, illegible, or garbled entries, social media comments or posts; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, social media comments or posts, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person's computer or mobile device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of the email account associated with the entry at the time of entry and he/she must comply with these Official Rules. The authorized account holder is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other service provider responsible for assigning email addresses. Sponsor may disqualify anyone from participating in the Sweepstakes or winning a prize (and void all associated entries) if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair play practices, or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives. Sponsor reserves the right in its sole discretion to cancel or suspend any portion of the Sweepstakes for any reason, including should any cause corrupt the administration, security or proper play of the Sweepstakes and, in the event of termination, to select the potential winners in a random drawing from all eligible, non-suspect entries received up to the time of such action.

LAWS AND DISPUTES: These Official Rules shall be governed and construed according to the law of the State of Colorado without regard to conflict-of-law provisions and as applicable to contracts entered into and to be wholly performed by parties located within the State of Colorado. In the event that any dispute arises regarding the Sweepstakes or these Official Rules, participants agree that such disputes shall be resolved individually without resort to any form of class action by arbitration conducted in Colorado by a single arbitrator according to the commercial arbitration rules of the American Arbitration Association. In any such dispute, under no circumstances will participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys fees and costs and further waives all rights to have damages multiplied or increased.
